Useful Spanish Terms that are used when buying and selling properties in Spain
Traspaso is the usual type of business purchase in Mallorca. The landlord owns the building shell and you own everything else including the business which will be transferred into your name. The minimum lease is for five years and can generally be reviewed for another term without a further premium other than the cost of the paperwork.
Once you have made a contract with the landlord, the rent is fixed and can only be increased thereafter by the annual 'cost of living index' as published by the Spanish government, which has been between 2% and 3% for years.
In Spain, you only need to give two months written notice and the property will revert back to the landlord. If you decide to sell (Traspass) the business, the landlord will generally agree a new lease to the buyer for the original length of the lease but is entitled to 10% of your selling price. Other than non payment of rent or property destruction, the landlord cannot terminate the lease without going through a very lengthy and expensive court system. On average, Spanish landlords are fine and mostly agreeable as long as the rent is paid on time.
